Terms of use
Last updated 27 October 2026.
These terms add to Apple's standard Licensed Application End User License Agreement, which also applies to OpVitae. If the two conflict, Apple's agreement governs. By using OpVitae you agree to both. OpVitae is made by Emivy Studio, LLC ("Emivy Studio", "we").
1. A record-keeping tool, not medical advice
OpVitae helps physicians keep their own professional records: operative cases, CME, credentials and board requirements. It is not a medical device. It does not diagnose, treat, or support clinical decisions, and nothing in it is medical advice. Do not use it to make decisions about a patient's care.
2. Your records, and checking them
You are responsible for what you enter and for checking it. Details read from a sticker or a certificate, or taken from dictation, are suggestions shown for you to confirm before they are saved; they can be wrong. Counts, totals and deadlines are worked out from what you enter and are only as accurate as it.
3. Board and credentialing requirements
OpVitae summarizes the published rules of boards and credentialing bodies (for example, renewal cycles and CME requirements) to help you keep track. Those bodies set and change their own rules, and they, not OpVitae, decide what you must do and by when. Confirm every requirement and deadline with the body concerned. Emivy Studio is not affiliated with, or endorsed by, the American Board of Surgery, the American College of Surgeons, or any other board or credentialing body. Their names are used only to identify the requirements OpVitae helps you track.
4. Patient information
If you enter patient information, you are responsible for being permitted to, under your institution's policies, any agreement you are bound by, and the law that applies to you. OpVitae keeps patient information on your iPhone; it is never sent to Emivy Studio and never stored in iCloud. When you export or share a file, where it goes is your choice and your responsibility. Emivy Studio does not receive, store or transmit patient information.
5. Keeping a copy of your case log
There is no copy of your case log anywhere but your iPhone: not with Emivy Studio, not in iCloud. If your iPhone is lost, damaged or erased, the case log is lost unless you have kept a copy with Export everything, which the app reminds you to make. Keep your recovery phrase safe: without it, encrypted details cannot be recovered if their keys are lost, and Emivy Studio cannot recover them.
6. Free start, free trial and subscription
Without a subscription you may add up to 10 cases and 2 credentials. To add more, you may start Apple's two-week free trial, after which the subscription you chose renews automatically at the price shown until you cancel in your Apple ID settings. Purchases, renewals, cancellations and refunds are handled by Apple under Apple's terms. If you don't subscribe, or your subscription ends, everything you entered stays on your iPhone, readable and exportable; adding records and some features are paused until you subscribe.
7. No warranty; limits of liability
OpVitae is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, Emivy Studio is not liable for any loss of data, missed deadline, credentialing or board outcome, or decision made using the app, or for any indirect or consequential loss. Where liability cannot be excluded, Emivy Studio's total liability is limited to the amount you paid for OpVitae in the twelve months before the claim.
8. Changes
We may update these terms; we will change the date above and, for a material change, say so in the app before it takes effect.
9. Law and contact
These terms are governed by the laws of the State of Texas. Emivy Studio, LLC, 5900 Balcones Drive, Suite 100, Austin, TX 78731. support@emivy.studio.
